Welcome to Kickstart. These Terms and Conditions (“Terms”) govern your access to and use of the Kickstart marketing website, web application, and mobile applications (collectively, the “Services”). By accessing or using Kickstart, you agree to be bound by these Terms. If you do not agree, please discontinue use of the Services.

 

1. About Kickstart (Service Overview)

Kickstart is a cloud-based SaaS platform built for service-based businesses such as plumbing, HVAC, landscaping, pool cleaning, pest control, and similar industries.

Kickstart enables businesses to manage their operational workflow, including:

  • Customer management
  • Job creation and scheduling
  • Field job execution and job slips
  • Invoice generation
  • Payment collection and tracking

Throughout these Terms, “Kickstart”, “we”, “us”, or “our” refers to Kickstart and its operators. “You”, “User”, or “Business” refers to any individual or entity using the Services.

 

2. Eligibility and Acceptance

You must be at least 18 years old and legally capable of entering into a binding agreement to use Kickstart. If you are using Kickstart on behalf of a company, you confirm that you have the authority to bind that company to these Terms.

By using the Services, you acknowledge that you have read, understood, and agreed to these Terms.

 

3. Account Registration and Access

To access Kickstart features, you must create an account.

You agree to:

  • Provide accurate and current business information
  • Maintain the confidentiality of your login credentials
  • Ensure that only authorized users access your account

You are fully responsible for all activity conducted through your account, including actions performed by employees, contractors, or field staff.

 

4. Kickstart Workflow and User Responsibilities

Kickstart supports the following core workflow:

Customer → Job → Job Slip → Invoice → Payment

You acknowledge and agree that:

  • You are responsible for the accuracy of customer details, job data, job slips, invoices, and payment records entered into Kickstart
  • Job slips created through the mobile app serve as internal service records and may be converted into invoices
  • You are solely responsible for verifying invoice amounts, taxes, and compliance with local laws before sending invoices to customers
  • Payment records reflect transactions processed through third-party providers and may be subject to delays or reconciliation differences

Kickstart does not guarantee payment collection or customer payment completion.

 

5. Subscriptions, Trials, and Billing

Certain Kickstart features require a paid subscription.

  • Subscription plans, pricing, and billing cycles are displayed on the website or within the app
  • Free trials, if offered, automatically convert to paid subscriptions unless canceled before the trial ends
  • Payments are processed by third-party payment processors such as Stripe
  • Subscription fees are non-refundable unless required by law

We reserve the right to modify pricing or plans with prior notice.

 

6. Payments and Third-Party Integrations

Kickstart integrates with third-party services for payments, communications, analytics, and accounting.

You acknowledge that:

  • Kickstart does not store full payment card details
  • Payment processing is governed by the terms and policies of third-party providers
  • Kickstart is not responsible for payment failures, chargebacks, refunds, or disputes handled by third-party processors

Your use of integrated services is at your own risk.

 

7. Customer Data and Content Ownership

You retain ownership of all data you upload or generate using Kickstart, including customer records, job data, job slips, invoices, and payment information (“Customer Data”).

By using Kickstart, you grant us a limited, non-exclusive license to store, process, and display Customer Data solely to provide and improve the Services.

You are responsible for:

  • Obtaining consent from your customers where required
  • Ensuring compliance with data protection and privacy laws
  • Maintaining appropriate backups of critical business data

 

8. Acceptable Use Policy

You agree not to misuse the Services. Prohibited actions include:

  • Using Kickstart for illegal, deceptive, or fraudulent activities
  • Uploading malicious code or attempting to compromise system security
  • Reverse engineering, reselling, or sublicensing the Services
  • Interfering with system performance or data integrity

We reserve the right to suspend or terminate accounts that violate these rules.

 

9. Data Privacy

Your use of Kickstart is governed by our Privacy Policy, which explains how we collect, use, and protect your personal and business data.

Please review the Privacy Policy carefully before using the Services.

 

10. Service Availability and Updates

While we strive to maintain high availability, Kickstart is provided on an “as is” and “as available” basis.

We may:

  • Perform maintenance or updates without prior notice

11. Intellectual Property Rights

All intellectual property rights related to Kickstart, including software, source code, workflows, branding, logos, and website content, are owned by or licensed to Kickstart.

You may not copy, modify, or use Kickstart intellectual property without written permission.

 

12. Termination and Account Closure

We may suspend or terminate your account if you:

  • Breach these Terms
  • Fail to pay applicable fees
  • Use Kickstart in a way that poses legal, financial, or security risk

You may stop using Kickstart at any time. Upon termination, access to the Services will be revoked.

 

13. Disclaimer of Warranties

Kickstart is provided without warranties of any kind, whether express or implied.

We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

 

14. Limitation of Liability

To the maximum extent permitted by law, Kickstart shall not be liable for:

  • Indirect or consequential damages
  • Loss of profits, revenue, data, or business opportunities

Our total liability shall not exceed the amount paid by you to Kickstart in the twelve (12) months preceding the claim.

 

15. Indemnification

You agree to indemnify and hold harmless Kickstart from any claims, damages, losses, or expenses arising from:

  • Your use of the Services
  • Your Customer Data
  • Your violation of these Terms or applicable laws

 

16. Changes to These Terms

We may update these Terms periodically. Changes will be posted on this page with a revised “Last updated” date.

Continued use of Kickstart after changes take effect constitutes acceptance of the updated Terms.

 

17. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Kickstart operates, without regard to conflict of law rules.
